Infant Guardianship (xposted in r/legaladvice)


Backstory: So this sets place in West Virginia for reference. Family friend who we hadn’t seen in a while got his girlfriend pregnant and needed a place to stay. While we were not connected to them they lost 3 children. While staying with us they asked us to take this one. We agreed.So, The baby was born on July 15th, at home due to mothers preference because of COVID. Midwife checked mother and child and everything was fine. On July 17th we filed for infant guardianship in family court and parents said they wouldn’t fight it (since it was their idea to begin with). Before we could make it home child protective services was at our home asking questions but did not see the child. By the following Thursday (the day before we had our hearing to be granted guardianship) they showed up and removed the child saying he was abused and neglected (remember they had never seen him). They cancelled our petition and arranged for the parents to go to circuit court basically having them fight for custody again, which didn’t make sense because our petition was them allowing us to gain guardianship.Where do we go from here?
